Welcome to the SBA online community service (hereinafter referred to as the ‘”Community”). The Community aims to be a valuable online resource where members can meet to network, communicate, share data and information and optimize business efficiency.
This agreement describes the terms under which you may use the service provided by the “Community Operator”, who is legally responsible for the community. Upon registration as a member you will have to confirm your agreement to the Terms of Use and the Data Protection Policy.
The Community Operator has the right to change the Terms of Use at any time. Any changes will be communicated in advance by posting the modified terms on this website. Your continued use of the Community indicates your acceptance of the modifications.
Community Service
The goal of this community is to connect you with other people in your industry and business environment. The Community Operator provides you with an advanced technological platform to do so.
Membership Terms
Community membership is restricted to members of the SBA and is by invitation only; either from the Community Operator or by using the Community application process. Invitations should only be offered to persons known to an SBA member.
Members may only register under their real name. Nicknames or pseudonyms are forbidden. No member shall have more than one account. Selling, trading, or otherwise transferring your Community account to another party, is not allowed.
Community membership is not open to minors (under 18 years of age) or to any users suspended or removed from the system by the community operator or from a representative of the system provider, peakfactor GmbH, for any reason.
For data security related issues please refer to our Privacy Policy, which must be accepted upon membership registration.
Signing up for a service provided by third parties may also require agreeing to Terms of Use / Services of those third parties.
Termination
Members may terminate their Community membership (does not interfere with SBA membership) at any time and for any reason.
The Community Operator is allowed to suspend membership for any reason at any time to prevent misuse and violation of the Terms of Use. The Community Operator is allowed to terminate any membership immediately and without notification in case of a proven breach of the Terms of Use.
In case of membership termination, all data entered to the profile will be removed – as soon as is technically reasonable - and will no longer be accessible through the Community. Other content (e.g. documents, notifications, messages) made available by the member to other members is not removed. Back-up copies or archives for technical use may not be changed and may still contain profile data.
Member Conduct
Membership requires behavior that is appropriate for a professional environment. Any offence against the policies stated below should be reported to the Community Operator, using the Community messaging functions.
On registering, the member selects a password which should be kept discreet. The Community Operator will not request the user's password at any time or disclose it to any third party.
As a member, you agree not to:
- Transmit (by upload, posting, email or in any other way) or make available any content or material that:
a. Contains information you do not have the right to disclose
b. Infringes copyright, patents, trademarks or other proprietary rights
c. Contains advertising or promotional material not previously authorized by the Community Operator outside the personal members profile
d. Is unsolicited and might be understood as ‘junk mail’, ‘spam’ or ‘chain letters’
e. Contains software viruses, spy programs or other code designed to interrupt, destroy or limit the functionality of any hardware or software.
- Start any activities within the Community that are illegal, libelous, abusive, obscene, discriminatory, or otherwise objectionable.
- Stalk or harass anyone.
- Deliberately interfere with or disrupt the Community service.
- Disguise your true identity or the origins of your communication.
- Falsely state your position and qualifications (past or present).
- Deliberately post junk-content in content fields.
- Use the upload function, intended for a personal photo, to incorporate company logos, promotional signs or any other improper displays.
- Display or communicate data or content from the community or its members, outside the community.
Unauthorized or illegal use of the Community - including tracking, collecting or analyzing personal data, e-mail addresses, or other personally identifiable information of members by electronic or other means - is forbidden.
Unauthorized usage includes the use of anonymous data from the community website. As a member you may not authorize, enable or otherwise grant to any other person and/or third parties, access to your profile or other content uploaded on the website.
Rights of the Community Operator
The Community Operator reserves the right to remove or alter any content provided by members in the Community groups, discussions, forums, events-section, library or other places outside the personal profile.
The Community Operator’s rights to contact the member on his community account and the registered e-mail is defined in the Privacy Policy of this community.
Warranties and Limitation of Liability
The Community Operator does not warrant that a member will successfully establish contacts or achieve his/her goals or requirements in relation to membership of the Community. The Community Operator cannot guarantee, and is not responsible for, the service being secure or error-free. Any material or information obtained through the Community is done so at the discretion of the member, who is solely responsible for any damage arising from such material or information.
The Community Operator makes no warranty that the quality of any products, services, information or other material purchased or obtained by the member through the Community service will meet the members’ expectations.
The Community Operator is not responsible or liable for:
a. Actions, statements or declarations by members.
b. Any data or information provided by any user or third party websites.
c. Any incorrect or inaccurate content posted on the website or in connection with its services, either by members, advertisers or corporate partners.
The member understands and explicitly agrees that the Community Operator is not liable for any direct, indirect, incidental, special, consequential or exemplary damages (even if the Community Operator has been advised of the possibility of such damages).
Some of the above limitations may not apply to all members, as some jurisdictions do not allow the exclusion for some warranties, or a limitation or exclusion of liabilities for incidental or consequential damages. In no event will the Community Operator’s total cumulative damages exceed CHF 500.
Access and Availability
The member agrees that it is technologically impossible for the Community website to be available without interruptions. The Community Operator aims to use its best efforts to provide a constant service. Maintenance works or events beyond the Community Operators’ sphere of control may however result in disturbances or in temporary interruptions to the Community services provided. The Community Operator cannot guarantee that errors in the software are corrected.
Governing Law and International Use
The member agrees to comply with all applicable local regulations, including but not limited to, regulations governing online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data from the country in which you reside.
This Terms of Use including the Privacy Policy and the relationship between the Community Operator and its users are governed exclusively by Swiss law.
To guarantee a top level service the operator kindly requests all members to immediately report any violations against the community ‘Terms of Use’ or other policies.
